Terms and conditions

These terms describe the use of ParkShark’s website and mobile apps, and the responsibilities of people finding or offering parking.

Alpha draft — not yet in effect

The provisions below are proposed terms for the current service and are not yet in effect. The operator is identified below; a full postal contact address has not been provided.

1. About ParkShark

ParkShark provides software to discover parking and, where available, publish spaces and manage bookings. “You” means the person using the service. A “space provider” is a person authorised to offer a parking space; a “driver” is a person seeking or using one.

ParkShark is operated by Yurii Smolii as an individual, based in 8052 Zurich, Switzerland. Yurii Smolii is the contracting party for the app and website service. Contact: support@parkshark.online.

A space provider is responsible for making an offered space available. ParkShark does not take possession of your vehicle, supply vehicle insurance or promise that a parking space is supervised or guarded. Any parking arrangement between a driver and a space provider is separate from the use of ParkShark’s software and remains subject to applicable law.

These terms must be made available before you enter an agreement using the service. They do not turn a demonstration, draft or unconfirmed request into a parking reservation. Your mandatory legal rights are unaffected.

2. Eligibility and accounts

You must have the legal capacity and any required authority to enter the relevant agreement. To drive or offer parking, you must meet the legal requirements that apply to that activity. If you act for a company or another person, you must be authorised to do so.

Provide accurate account and contact information and keep it up to date. Protect your sign-in credentials, do not share an account in a way that compromises security, and promptly report suspected unauthorised access. You are responsible for actions you authorise through your account; responsibility for unauthorised activity remains subject to applicable law.

Guest access and account requirements vary by feature. Creating an account does not establish ownership of a space, verify a listing or guarantee a booking.

3. Available features

Android: the current app provides a map, optional device location and local search/filter controls. It does not yet create parking accounts, publish listings, make bookings or process payments.

iOS: the current app also includes accounts, profiles, vehicles, parking listings, photos and booking management. Features may differ by version. The website introduces the service and provides support and policy information.

Some features are still in development. An advertised future feature is not a promise that it is currently available. A screen labelled as a demonstration or development experience must not be relied on as proof of payment or authority to occupy a real parking space.

4. Listing a parking space

Only offer a space you own or are authorised to make available. Obtain any necessary landlord, co-owner, building-management or other permissions, and comply with local parking, planning, safety and tax requirements.

Describe the location, dimensions, vehicle restrictions, accessibility, availability, price and access arrangements accurately. Use photos you have the right to publish. Keep availability current and do not knowingly accept incompatible bookings for the same space.

Disclose material restrictions before a driver commits. Keep private access information out of public descriptions and images. Do not represent a space as secure, insured, accessible or suitable for charging unless that statement is accurate.

If you cannot honour an agreed booking or discover a safety issue, inform the driver and support promptly. You remain responsible for any obligations arising from your agreement with the driver.

5. Using a parking space

Check the destination, vehicle dimensions, restrictions, dates, times and access instructions before booking or arriving. Provide accurate vehicle details where required. Road signs, property restrictions and lawful instructions take precedence over an estimated map position or route.

Use the space only for the agreed vehicle, purpose and period. Do not obstruct access, create hazards, damage property, transfer access to another person without permission or remain beyond the agreed time without a new arrangement.

Drive and park lawfully. Do not operate the app while driving. Report an inaccessible or unsafe space and contact support or the provider rather than entering without permission. For immediate danger, contact the emergency services.

6. Bookings and confirmation

Review the listing, parking time zone, vehicle information, selected interval, price and any cancellation conditions shown before confirming. Search results, a saved draft, an estimated price or an unfinished booking screen do not reserve a space.

Where booking is available, check the saved booking status in the app. A pending or failed request is not a confirmed reservation. Emails and push alerts are supplementary and may be delayed or unavailable.

The current iOS booking flow can create a confirmed booking record without collecting payment. Such a record is not a payment receipt. For any real-world use of a space during this development phase, obtain the provider’s agreement on access and any separate payment arrangements before arrival.

A long-term enquiry or contact with a provider does not by itself create a lease or give exclusive possession. Any additional agreement must be expressly agreed by the relevant parties. Changing dates or extending a stay requires availability and a new confirmed arrangement; do not assume an extension has been accepted.

7. Prices and payments

Neither current app processes card payments. A displayed booking total or price is not evidence that funds were collected or transferred. ParkShark does not currently provide an in-app payment receipt, escrow service or automated payout.

Any separate payment obligation must be clearly agreed with the space provider before using the space. Do not send payment credentials to ParkShark support. These terms do not authorise an undisclosed platform fee, cancellation charge or automatic renewal.

If payment processing or platform charges are introduced, the applicable total, currency, fees, taxes, payment terms and refund conditions must be disclosed before you commit. Future payment features are not enabled by accepting this draft.

8. Cancellations and problems

Use the cancellation option in the booking detail when available and check that the booking status changes. The current app applies feature-specific cancellation availability, including a cutoff before a short stay starts. If the option is unavailable, the space cannot be used or a cancellation fails, contact the provider and ParkShark support promptly with the booking reference.

Any applicable cancellation charge or refund rule must be disclosed and agreed before the booking; this page does not create one. Since ParkShark does not currently collect payments, cancelling an app record does not trigger an automated refund. Any payment made separately must be addressed with its recipient, subject to the agreed terms and applicable law.

Deleting the app or an account does not cancel an existing agreement, resolve an active booking or remove any valid outstanding obligation. These terms do not remove any statutory cancellation, refund or other remedy available to you.

9. Acceptable use

Do not use ParkShark for fraud, unlawful discrimination, harassment, impersonation or other illegal activity. Do not publish misleading listings, disclose someone else’s personal information without authority, or use contact information obtained through a booking for unsolicited marketing.

Do not bypass access controls, obtain another user’s private information, interfere with the service, distribute malicious software, or copy service data in a way that infringes rights or materially disrupts operation. Legitimate security reports can be sent privately to support.

10. Content and intellectual property

You keep ownership of content you submit. You grant ParkShark the limited permission needed to store, format, display and transmit it to operate the features you use, including showing listings and preserving booking information as described in the Privacy Policy. This permission does not transfer ownership or authorise unrelated use of your content.

You must have the rights needed to submit content and must not infringe another person’s privacy or intellectual property. Tell support if you believe content is unlawful or violates your rights, identifying the relevant listing or material.

ParkShark’s app, website, branding and original materials remain protected by applicable intellectual-property rights. You may use the app and website for their intended purposes, subject to these terms and any applicable app-store licence. Third-party maps and other materials remain subject to their owners’ rights.

11. Maps and other providers

Maps, location estimates, routes and travel times can be incomplete or inaccurate. They do not establish permission to park or guarantee a journey time. Check the actual space, signs and access conditions.

Apple, Google, sign-in providers, app stores and navigation or email services may apply their own terms to the services they provide. Opening another app or external link may take you to a service ParkShark does not operate. The Privacy Policy explains the providers used by each platform.

12. Availability and responsibility

ParkShark may be interrupted by maintenance, connectivity problems, provider outages or defects. We do not promise uninterrupted availability, a particular number of spaces or that a particular listing will meet your needs. Keep the information you need for an agreed stay available independently of a notification.

Each party remains responsible under applicable law for its own conduct and obligations. Using the platform does not make ParkShark the insurer or custodian of a vehicle or property. Contact the provider and support if a problem concerns an agreed parking service.

Nothing in these terms excludes liability that cannot lawfully be excluded, including liability for intentional wrongdoing or gross negligence where applicable, or limits mandatory consumer rights. This draft does not impose a fixed liability cap or require you to waive statutory remedies.

13. Suspension and account closure

Access or content may be restricted where reasonably necessary to address a serious breach, fraud, security risk, unlawful content or legal requirement. Where practicable, we will explain the reason and allow you to respond; urgent protective action may be taken first. Contact support to request a review.

You can stop using ParkShark and, on iOS, request account deletion through Account → Edit profile → Delete account or by email. Address active bookings with the other party before closing an account. See the retention and deletion section for what the current deletion process removes and retains.

Ending access does not retrospectively change an existing agreement or extinguish rights and obligations that must continue to resolve it.

14. Privacy and communications

The ParkShark Privacy Policy explains how information is handled on both platforms and the website, including location, profiles, listings, bookings and analytics. Acceptance of service terms is not a substitute for any separate permission or consent required for data processing.

Manage iOS email, push and analytics preferences in Account → Privacy and device permissions in system settings. Service communications and replies to your requests may still be needed. The website support form opens a draft in your email app; you must send it to contact us.

15. Changes, disputes and contact

Changes will be identified by an updated date. Material contractual changes will be communicated before they apply, with acceptance obtained where required. New terms do not retrospectively alter an existing booking. You may stop using the service if you do not accept proposed future terms, subject to existing obligations.

If a dispute arises, contact support@parkshark.online with the relevant booking or listing reference and the outcome you seek. We will review issues concerning the platform and help identify the appropriate party for parking-related issues.

Applicable law determines your rights and the competent courts. This draft does not select an exclusive court, require arbitration or remove protections you have under mandatory local law. If any provision cannot be enforced, the remaining provisions apply to the extent permitted by law.
